This matter is taken up by video conferencing mode. 2.

Heard learned counsel for the parties.

The petitioners have filed this application seeking direction to the opposite parties to steps to disburse the differential arrear dues from 01.01.2016 to 30.09.2017 i.e. from the date of fixation of pay under the ORSP, Rules, 2017 to the date of receiving the revised scale, as fixed by modifying the resolution dated 19.12.2017 under Annexure-3.

In course of hearing, learned counsel for the petitioners states that the petitioners have already made representation before opposite party no.1 vide Annexure-5, and the same may be directed to be disposed of taking into consideration the judgment of this Court in the case of Dipti Roy v. State of Orissa, 2004 (II) OLR 718 within a stipulated time, to which learned Standing Counsel for School and Mass Education Department has raised no

objection.

As agreed by learned counsel for the parties, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing opposite party no.1 to consider the representation filed by the petitioners under Annexure-5 taking into consideration the judgment of this Court in the case of Dipti Roy v. State of Orissa, 2004 (II) OLR 718, and pass a reasoned and speaking order as expeditiously as possible, preferably within a period of three months from the date of receipt of the certified copy of this order.

Issue urgent certified copy as per rules.
