This matter is taken up through hybrid mode.

This writ petition has been filed for early disposal of Second Appeal No.398 of 2021 stated to be pending before the State Information Commission, Odisha, Bhubaneswar-Opposite Party No.1.

It is submitted by Mr. Sahoo, learned counsel for the Petitioner that although the appeal has been filed since 13th January, 2021 (Annexure-3), but the same is still pending for consideration. There is no legal impediment for early disposal of the appeal.

Miss Behera, learned counsel appearing on behalf of Mr. Dash, learned counsel for the State Information Commission submits that she has no instruction in the matter. However, the Petitioner may move the Commission, if he is aggrieved for pendency of the appeal.

In view of the above, this writ petition is disposed of with an observation that the Petitioner, if so advised, may move the State Information Commission, Odisha, Bhubaneswar-Opposite Party No.1 for early disposal of Second Appeal No.398 of 2021. Urgent certified copy of this order be granted on proper application.
