Mr. Behera, learned advocate appears on behalf of petitioner and submits, his client has agreement dated 10th May, 2022 for supply of cooked food to indoor patients of the Sub-Divisional Hospital (SDH). The agreement, though initially for period of three months but was subsisting thereafter. Termination requires one month's notice. 2.

He draws attention termination letter dated 21st November, 2022 and points out his client has been directed to hand over the hospital canteen to the new contractor on 30th November, 2022. The notice period is in breach of the agreement term. 3.

Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State.

Impugned termination notice dated 21st November, 2022 is set aside and quashed. It goes without saying that parties are to act in terms of said agreement dated 10th May, 2022. 5.

The writ petition is disposed of.
