This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

On oral prayer made by the learned counsel for the Petitioner, he is permitted to furnish the C.T. Case number as well as court name in the cause title and the contents of the bail application. 3.
Heard learned counsel appearing for the Petitioner and learned Additional Government Advocate appearing for the State-Opposite Parties.

The Petitioner is seeking pre-arrest bail in connection with Harabhanga P.S. Case No.109 of 2022, corresponding to C.T. Case No.274 of 2022, pending in the Court of learned J.M.F.C., Harabhanga, registered for alleged commission of offences punishable under Sections 420/272/273 of the I.P.C. read with Section 20 of the Cigarettes and Other Tobacco Products Act, 2003 and Sections 51, 52, 53, 56, 57, 59 and 63 of the Food Safety and Standards Act, 2006.

Considering the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant pre-arrest bail to the
// 2 // Petitioner. However, it is directed that in the event the Petitioner surrenders and moves an application for bail before the Court in seisin over the matter within a period of three weeks from today in the aforesaid case, the Court in seisin over the matter shall release him on bail on such terms and conditions as it would be deemed just and proper with further condition that the Petitioner shall not indulge in similar nature of offences while on bail. Violation of any of the terms and conditions shall entail cancellation of bail. 6.
Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
