This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Marine P.S. Case No. 27 of 2022 corresponding to G.R. Case No. 855 of 2022 pending in the Court of learned S.D.J.M., Chatrapur, Ganjam for alleged commission of offences under sections 498-A, 294, 323, 307, 506 of the Indian Penal Code.

The bail application of the petitioner has been rejected by the learned Addl. Sessions Judge, Chhatrapur, Ganjam as per order dated 20.09.2022. Considering the submission made by the

// 2 // learned counsel for the petitioner that the petitioner is in judicial custody since 01.09.2022 and charge sheet has been submitted under sections 498-A, 294, 323, 307, 506 of the Indian Penal Code and the case arises out of a matrimonial dispute and the injured has sustained simple injury, which is not disputed by the learned counsel for the State after verification of the injury report, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with such other conditions as the learned Court may deem just and.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
