Heard learned counsel for the Parties.

There is no disputed in Bar as to coverage of a judgment of this Court in W.P.(C) No.12489 of 2022 passed on 12.10.2022 so far the matter involves pre-position and post position to the case at hand but there is still some exercise required to be done. Mr.Mohapatra, learned counsel for the Development Authority while not disputing coverage of the judgment but however submits the Petitioner eligibility otherwise is also to be ascertained before taking a final call. Keeping in view the above, this Court in disposal of the Writ Petition directs the Development Authority to complete the exercise on the request of the Petitioner in the event of any ascertainment still required may also involve Petitioner and take a final call at least within a period of one and half months from the date of communication of this order by the Petitioner. The decision process shall involve judgment of this Court in W.P.(C) No.12489 of 2022 passed on 12.10.2022.
