This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Rampur P.S. Case No. 43 of 2022 corresponding to G.R. Case No. 61 of 2022 pending in the Court of learned J.M.F.C., S. Rampur for the alleged commission of offence under section 395 of the Indian Penal Code.

The prayer for bail of the petitioner was rejected by the learned Sessions Judge, Sonepur vide order dated 21.11.2022.

// 2 // Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 08.05.2022 and he has been implicated in the case basing on the confessional statement of the co-accused before police and two of the co-accused persons have already been released on bail in BLAPL No.6989 of 2022 and BLAPL No.7186 of 2022 and after hearing the learned counsel for the State I am inclined to release the petitioner on bail. Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.20,000/- (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.

Accordingly, the BLAPL stands disposed.

Urgent certified copy of this order be granted on proper application.
