This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Chhendipada P.S. Case No. 390 of 2021 corresponding to C.T. (NDPS) Case No.5 of 2021 pending in the Court of learned Sessions Judge -cum- Special Judge, Angul for the commission of the alleged offences punishable under sections 20(b)(ii)(C) and 29 of the N.D.P.S. Act.

Perused the first information report.

It is a case of seizure of commercial quantity of ganja from the possession of the co-accused and the

// 2 // petitioner is stated to have been implicated in the case basing on the confessional statement of the coaccused before police. In view of the bar under section 37 of the N.D.P.S. Act, I am not inclined to grant anticipatory bail to the petitioner.

The petitioner is at liberty to surrender and move for bail in the event of which the learned Court below shall dispose of the same in accordance with law. The case records shall be made available to the Court concerned.

The ABLAPL stands disposed of.
