Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 11.09.2021 in connection with Tumusinga P.S. Case No.59 of 2018 corresponding to G.R. Case No.244 of 2018 pending in the Court of learned S.D.J.M., Kamakhsya Nagar for the alleged commission of offence under Sections 498(A)/302 of IPC. 4.
It is alleged that the petitioner being the husband of the deceased assaulted her by pressing her neck and also by means of a stone on her head leading to her death.

Considering the nature of accusations and the availability of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore, rejected. It is submitted that trial has already commenced. In such view of the matter, liberty is granted to the petitioner to renew his prayer after examination of some materials witnesses in the case.

BLAPL is accordingly rejected.
