This matter is taken up through Hybrid arrangement (video conferencing/physical Mode).
Heard learned counsel for the petitioner and Mrs Jyotsnarani Tripathy, learned Addl. Standing Counsel for the Vigilance Department.
This is an application under section 439 of Cr.P.C. in connection with V.G.R. Case No.21 of 2022 arising out of Sambalpur Vigilance P.S. Case No.40 of 2022 pending in the Court of learned Special Judge (Vigilance), Bolangir for offence punishable under section 7 of the Prevention of Corruption (Amendment) Act, 2018.
The petitioner moved an application for bail before the Court of learned Special Judge (Vigilance), Bolangir which was rejected on 21.11.2022.
Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 17.11.2022 and investigation has made substantial progress and there is no chance of his absconding and therefore, the bail application of
// 2 // the petitioner may be favourably considered.
Mrs Jyotsna Rani Tripathy, learned Addl. Standing Counsel for the Vigilance Department, on the other hand submitted that the trap was successful one.
Considering the submissions made by the learned counsel for both the parties, the nature of accusation against the petitioner, the progress of investigation and the period of detention of the petitioner in judicial custody, I am inclined to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000.00 (rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper with further condition that the petitioner shall appear before the Investigating Officer as and when required and co-operate with the investigation and he shall also appear before the learned trial Court on each date when the case would be posted for trial and he shall not try to tamper with the prosecution evidence.
Violation of any of the terms and conditions fixed shall entail cancellation of bail.
The BLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on propr application.
