This matter is taken up through Hybrid Mode.

Heard Mr. P.K. Parida, learned counsel for the petitioner and Mr. K.K. Gaya, learned Additional Standing Counsel for the State.

At the stage of accused statement because of nonappearance of the petitioner, the learned Special Court under SC & ST (POA) Act, Cuttack in S.T. No. 79 of 2016 was constrained to issue NBW.

Learned counsel for the petitioner submits that the default was unintentional and for reasons beyond control of the petitioner.

Taking into account such submission, this court directs that the petitioner shall appear on 21st of March, 2022 and on such appearance, he shall be released on bail on the earlier terms and it

shall be open to the learned Court below to record the Accused Statement, if its docket so permitted on any other date deemed suitable.

The CRLMC thus stands disposed of.
