This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Airport P.S. Case No. 40 of 2021 corresponding to C.T. Case No.760 of 2021 pending in the Court of learned S.D.J.M., Bhubaneswar for the commission of the alleged offences punishable under sections 370, 120-B of the Indian Penal Code, sections 3,4, 5, 6, 7 of Immoral Traffic Prevention Act, 1956, sections 67 and 67A of the Information Technology Act and under section 6 of the Indecent Representation of Women (Prohibition) Act, 1986.

// 2 // Learned counsel for the petitioner submitted that some of the co-accused persons have already been released on bail and the petitioner has not been arrayed as an accused in the F.I.R. and therefore, the anticipatory bail application may be favourably considered.

Learned counsel for the State opposed the prayer for anticipatory bail.

Considering the submissions of the learned counsel for the parties and the nature of accusation against the petitioner, while not inclining to grant anticipatory bail to the petitioner, liberty is granted to the petitioner to surrender and move for bail in the event of which the learned Courts below shall dispose of the same in accordance with law expeditiously and the claim of parity with that of the co-accused persons shall be taken into account at the time of adjudication of the bail application. The case records shall be made available to the Court concerned. The ABLAPL stands disposed of.
