Heard learned counsel for the petitioner and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. has been filed by the petitioner challenging the order dated 23rd September, 2015, passed by the learned Addl. Sessions Judge, Champua in S.T. No.81(A) of 2014 arising out of G.R. No.705 of 2009 in Barbil P.S. Case No.298 of 2009 on the grounds stated therein. 3.
It is submitted by learned counsel for the petitioner that petitioner was granted bail pursuant to order passed in BLAPL No.24927 of 2013, however, due to his default on the date fixed i.e. 23rd September, 2015, the learned court below issued NBWA against him.

Having regard to the submission of learned counsel for the parties, the Court is inclined to direct the petitioner to surrender and move for bail. Accordingly, it is ordered.

The petitioner is directed to surrender before the Addl. Sessions Judge, Champua on or before 3rd November, 2022 in S.T. No.81(A) of 2014 arising out of G.R. No.705 of 2009 in Barbil P.S. Case No.298 of 2009 and move for bail and in such an event, he shall be released on bail with conditions as deem fit and proper by the court below. However, before directing his release on bail, the learned court below shall verify and confirm as to if the petitioner was on bail pursuant to the order of this Court in BLAPL No.24927 of 2013 6.
The CRLMC stands disposed of.
