Heard learned counsel for the appellant and learned counsel for the State.

The appellant is in custody in connection with Baramba P.S. Case No. 169 of 2020 corresponding to C.T. Case No. 116 of 2020 pending in the court of learned Presiding Officer, Special Court, (SC & ST), Cuttack for the alleged commission of offence under Sections 341/294/323/307/506/326 of IPC read with Section 3(1)(r)(s)/3(2)(va) of SC & ST (PoA) Act.

The appellant is a police constable. On the date of occurrence, he had an altercation with the informant along with other persons. It is alleged that the appellant and the other culprits assaulted the informant causing grievous injuries.

It is submitted by Mr. S.R. Das, learned counsel for the appellant that the allegations are omnibus and general in nature and in any case not relatable to the appellant. The only allegation against the appellant is that he had dealt a slap on the informant's cheek. He further

submitted that the person who had actually assaulted the informant have been left out in the charge sheet.

Considering the submissions as above and on perusal of the materials on record, this Court finds no reason to detain the appellant in custody any longer. The CRLA is therefore, allowed. 7.

Let the appellant be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose.

The CRLA is accordingly disposed of.
