The Petitioner in this writ petition prays for a direction to release his vehicle bearing Registration No.OD-05-AQ-9129 (Truck) after receiving the sale amount of Rs.13,55,000/-. 3.
Mr. Behera, learned counsel submits that the Petitioner is the registered owner of the vehicle bearing Registration No. OD-05-AQ-9129 (Truck). Due to non-payment of the loan amount, the aforesaid vehicle was seized by the Opposite Party No.2-Financer and it has already been sold, but the ownership has not yet been transferred. Hence, this writ petition has been filed for a direction to release the aforesaid vehicle after accepting the sale value.

Since the vehicle has already been sold in a public auction, the writ petition in absence of the purchaser is not maintainable.

This writ petition is, therefore, disposed with an observation that the Petitioner, if so advised, may approach the Opposite Party No.2-Financer for redressal of his grievances. Urgent certified copy of this order be granted on proper application.
