1. This matter is taken up through hybrid mode. Order No.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 12th September, 2021 in connection with Chandapur P.S. Case No.1/2017 corresponding to T.R. Case No.112/2021 pending in the court of learned Addl. Sessions Judge-cum-Special Court under POCSO Act, Nayagarh for the alleged commission of the offence under Sections 363/366/376(2)(n) of I.P.C.

It is submitted by learned counsel for the Petitioner that after being released on interim bail, the Petitioner made several attempts to amicably resolve the dispute with the victim to the effect that he proposed to accept the victim as his wife as also the child as his own. However, the family members of the victim are said to have refused the offer.
5. Be that as it may, considering the nature of accusations, the period of detention in custody and in particular taking into account the statement of the victim recorded under Section 164 of the Cr.P.C., I am inclined to allow the prayer for bail.
6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.
7. The BLAPL is disposed of.
8. Urgent certified copy of this order be granted on proper application.
