This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

The petitioners are in custody since 04.11.2022 in connection with Khurda Sadar P.S. Case No. 219 of 2022 corresponding to G.R. Case No. 1839 of 2022 pending in the Court of learned S.D.J.M., Khurda for the alleged commission of the offence under Sections-379/411/120-B/34 of the I.P.C read with Section-51(i) of the OMMC Rule and Section-12 of the OMPTS and OTH Unlawful Activities Act and Sections-3 and 4 of the E.S. Act. 4.
It is alleged that the petitioners and some other persons were illegally blasting and transporting black stones at a stone quarry under Kaipadar Mouza, when a raid was conducted by the Additional Settlement Officer, SJTA, Puri. It is submitted that one Malati Routray is authorized to operate the quarry and the petitioners are her labourers who were working in the quarry on her instruction. One Biswanath Khandayatiray@ Khandeitaray @(Dipu) has been granted anticipatory bail by this Court in ABLAPl No.
14613 of 2022.

Having regard to the above facts, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose.

Accordingly, the BLAPL is disposed of.
