Heard learned counsel for the petitioner and learned Additional Standing Counsel appearing for the Vigilance. 3.

The petitioner is in custody since 06.11.2021 in connection with Balasore Vigilance P.S. Case No.21 of 2021 corresponding to V.G.R. Case No.08 of 2021 of the court of learned Special Judge, Vigilance, Balasore for the commission of offence under Section 7 of the Prevention of Corruption (Amendment) Act, 2018.

It is alleged that the petitioner was caught red handed while accepting bribe of Rs.2,000/- from the informant. It is submitted by learned counsel for the petitioner that the allegations are entirely false and that he has been falsely entangled in the case.

Learned Additional Standing Counsel appearing for the Vigilance submits that the petitioner had earlier demanded bribe from the informant for rescuing his daughter and

therefore, he is to be treated as a habitual offender. 6.

Having regard to the rival submissions, the materials on record and the period of detention already undergone, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall cooperate with the investigation as and when required by the I.O. 7.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
