1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 27th October, 2021 in connection with Adava P.S. case No.79/2020 corresponding to G.R. Case No.48/2020 pending in the court of learned Special Judge, Parlakhemundi, Gajapati for the alleged commission of the offence under Section 20(b) (2)(C)/25/29 of the NDPS Act.

4. It is submitted that no contraband was seized from the possession of the Petitioner and he has been implicated entirely on the basis of the statement of the co-accused persons. A perusal of the F.I.R. also reveals that two persons, namely S.D. Dora and S. Sahoo, were apprehended by the Police and some contraband was seized from their possession. During interrogation, they are said to have confessed that they had procured the contraband from the present Petitioner.

5. Having regard to the submissions made and the materials on record, I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter including the condition that he shall appear before the court below on each of posting of the case without fail.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
