1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. P.S.Nayak, learned counsel for the Petitioner and Mr.S.K.Mishra, learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 21st November, 2021 in connection with Chandipur P.S.

Case No.91/2021 corresponding to C.T. Case No.970/2021 pending in the court of learned S.D.J.M., Balasore for the alleged commission of the offence under Sections 272/273/34 of I.P.C. read with Section 52(a) of Orissa Excise Act.

4. The prosecution allegation is that the Petitioner along with several other persons were preparing I.D. liquor in the rear of his house where they were apprehended by the staff of Excise Department.

5. Considering the submissions made, the materials on record, the period of detention already undergone and the fact that investigation into the case appears to have been progressed substantially, I find no justified reason to detain the Petitioner in custody any longer. The BLAPL is, therefore, allowed.

6. Let the Petitioner-Sashi @ Sashidhar Bhuyan be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
