This matter is taken up by hybrid mode.

2. This petition has been filed by the petitioner-husband with a prayer to transfer C.P. No.88 of 2020 pending in the Court of learned Judge, Family Court, Rourkela, Criminal Misc. Case No.10 of 2020 and Execution Case No.49 of 2021 pending in the Court of the learned J.M.F.C.(R), Rourkela either to Cuttack or Bhubaneswar to the Court having jurisdiction.

3. Prima faice it appears that this transfer petition will not be maintainable with multiple prayers.

4. However, during course of hearing, Ms.Kiran Choudhary, learned counsel for the petitioner states that the petitioner does not want to proceed with this case and prays for permission to withdraw the same with liberty to file a better application. To that effect a memo at Flag-A has already been filed.

5. Considering the submission made and in view of the memo filed, this TRP (CRL) is disposed of granting liberty to file separate applications.

Urgent certified copy of this order be granted as per rules. .........................
