This matter is taken up through Video Conferencing Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with I.C.C. Case No.03 of 2016pending in the court of learned Sessions Judge -cum- Special Judge, Ganjam at Berhampur for alleged commission of offences under sections 294/323/342/506/34 of the Indian Penal Code and section 3(I)(II)(III)(X) XI of SC and S.T. (POA) Act.

Learned counsel for the petitioner submitted that

// 2 // the summons have been issued to the petitioner in this case.

Since it is a complaint case and summons have been issued to the petitioner and there is no apprehension of arrest, I am not inclined to release the petitioner on anticipatory bail.

However, in case the petitioner appear in the learned Court below and moves for bail, the same shall be disposed of expeditiously in accordance with law and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account.

The ABLAPL stands disposed of.
