This matter is taken up by video conferencing mode. Order No.

This is an application under section-439 of the Cr.P.C. read with section-81 of the Cr.P.C. filed by the Petitioner for bail in connection with Misc. Case No.568 of 2021 of the file of Executive Magistrate, Khorda in Athmallik P.S. Case No.69 of 2014 corresponding to G.R. Case No.314 of 2014 on the file of learned S.D.J.M., Athamallik.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions made and going through the materials on records; further taking into account the other surrounding circumstances, it is directed that the Petitioner be released on transit bail for a period of 15 days on furnishing a bail bond of Rs.40,000/- (Rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the learned Court below in seisin over the matter with conditions

// 2 // that he shall appear before the Court concerned where the case is presently subjudice and moves for regular bail which shall be considered on its own merit without being influenced by the present order.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned Counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020 as modified by Court's Notice No.4798 dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
