Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties, more particularly opposite party no.1 to consider the case of the petitioner for retrospective promotion to the rank of Headmaster (Junior Grade Sub-ordinate Tribal Education Service (Class-III) as well as to the rank of senior Grade Sub-ordinate Tribunal Education Service (Class-II), considering the reservation of the present petitioner as P.H. category under the Orissa Subordinate Tribunal Welfare Education (Recruitment and Conditions of Service) Rules, 1993 read with Orissa Civil Service (Criteria for Promotion) Rules, 1992 and further to direct opposite party no.1 to consider the grievance of the petitioner under Annexure-10 series keeping in view the judgment passed by the apex Court in the case of Siddarraju v. State of Karnataka and others, Civil Appeal No. 1567 of 2017 within a reasonable time.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.1 vide Annexure-10 and the same may be directed to be disposed of within a stipulated time taking into consideration Annexure-9, to which learned State Counsel has raised no objection. 4.

As agreed to by learned counsel for the parties, however,

without expressing any opinion on the merits of the case, this writ petition stands disposed of directing the opposite party no.1 to consider the representation filed by the petitioner vide Annexure-10, taking into consideration Annexure-9, and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.

Issue urgent certified copy as per rules.
