This matter is taken up by video conferencing mode. Order No.

The Petitioner being in custody in connection with Birmaharajpur P.S. Case No.133 of 2021 corresponding to Special G.R. Case No.10 of 2021 on the file of learned Court of Sessions -cum-Special Judge, Sonepur running for commission of offence under sections -20(B)(II)(c)/25/29 of the NDPS Act read with section-25/27 of the Arms Act, has filed this application under section 439 of the Cr.P.C. for his release on bail.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions made, further keeping in view the factum of completion of investigation and submission of the charge-sheet after the rejection of the prayer for grant of bail to the Petitioner by the learned Sessions Judge, Sonepur, this application stands disposed of granting liberty to the

// 2 // Petitioner to renew his prayer before the Court in seisin of the case for his release on bail by citing all such developments which have taken place in the meantime for their consideration in proper prospective.

It is needless to state that if such a move is made, the same shall be considered on its own merit without being influenced by this order and disposed of early in accordance with law.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned Counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020 as modified by Court's Notice No.4798 dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
