1. The matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner and learned counsel for the State.

3. The petitioner has been charge-sheeted for the commission of offence under Sections 420, 468 and 471/34 of the IPC read with Sections 20(b)(ii)(C), 25 and 29 of the NDPS Act in Koraput Town P.S. Case No.222 of 2020 corresponding to T.R. Case No.41 of 2020 of the court of learned Special Judge, Koraput. He has filed this application for bail.

4. The allegation of the prosecution is that while the police was on patrolling duty, they seized contraband Ganja weighing to 3.11.400 kg.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 16.07.2020 and charge-sheet has been filed. He

// 2 // further submits that no contraband article has been seized from the possession of the petitioner. So, the bail petition may be allowed.

6. Learned counsel for the State vehemently opposed the bail prayer of the petitioner.
