3. The petitioner being in custody in Damanjodi P.S. Case No.65 of 2020 corresponding to T.R. Case No.46 of 2020 pending in the court of learned Special Judge, Koraput for the commission of offence under Sections 20(b)(ii)(C), 25 and 29 of the NDPS Act, has filed this petition for his release on bail.

4. The FIR allegation is that the contraband ganja weighing 374.880 kg has been seized from the offending truck bearing Registration No.UP-42 BT-1916 and the petitioner was the driver of the truck.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 12.08.2020 and the petitioner has no knowledge about the transportation of the ganja in the said vehicle.

6. Learned counsel for the State opposes the bail prayer of the petitioner as the ganja seized is more than the commercial quantity.

7. Considering the aforesaid facts and submissions, the BLAPL is rejected.
