Heard Mr. B. Karna, learned counsel for the petitioner. 2.

This application under section 482 of the Code of Criminal Procedure has been filed by the petitioner for quashing the order dated 01.11.2022 passed by the learned District & Sessions Judge, Boudh in S.T. No. 72 of 2017 arising out of Boudh P.S. Case No.276 of 2016 issuing NBW of arrest against the petitioner as no steps were taken on his behalf.

Although I find that no illegality in the impugned order 01.11.2022, as Mr. B. Karna, learned counsel for the petitioner submits that this is the first default of the petitioner and the petitioner will surrender in the learned Court below by 23.12.2022 and comply with all the conditions which may be imposed for releasing him on bail, I dispose of this CRLMC directing that in the event the petitioner surrenders in the Court of learned District & Sessions Judge, Boudh in S.T. No. 72 of 2017 by 23.12.2022 and files an application for bail, he shall be released on bail on such terms and conditions of the learned Court in seisin over the matter with further condition that the petitioner shall appear before the learned trial Court on each date when the case is fixed

Sukanta for trial and shall not influence prosecution witnesses or indulge in any criminal activity.
