Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.4092 of 2022, pending before the learned S.D.J.M., Sambalpur, arising out of Sambalpur Town P.S. Case No.392 of 2022, for commission of alleged offences under Sections 274/275/34 IPC. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Sambalpur by order dated 18.11.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the Petitioner is in custody since 31.10.2022 and has been remanded in the case at hand because of criminal proclivity.

Learned counsel for the State opposes the prayer for bail.

Taking into account the nature of allegation in the case at hand and the punishment prescribed, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view the criminal proclivity, additionally it is directed that the Petitioner shall appear before the jurisdictional police station once every week till submission of final form. 8.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
