The petitioner is stated to have availed a Cash Credit facility for a limit of Rs.10 Lakhs from Punjab National Bank, Buxi Bazar Branch, District-Cuttack, which was classified as NPA on 31st March, 2022 for non-servicing of the account. A Demand Notice dated 3rd June, 2022 was issued recalling the outstanding liability of Rs.5,08,087/-.

The challenge in the present Writ Petition is to the recovery process initiated under the SARFAESI Act, 2002.

At the time of hearing, learned counsel for the Bank submits that the petitioner has repaid the entire outstanding liability and the loan account stands closed on 13th December, 2022.

Learned counsel for the petitioner has filed a memo dated 14th December, 2022 in Court today stating therein that the petitioner has already paid the loan amount on 13.12.2022 and does not want to press this Writ Petition. The memo is taken on record. 4.

In view of the memo filed, the present Writ Petition is dismissed as not pressed.
