This matter is taken up through Hybrid arrangement (virtual/physical mode).

The short grievance of the Petitioner in the present writ application is that the Petitioner is not getting his retiral and pensionary benefit as admissible and due to him. Further he has sought for a direction to the Opposite Party No.1 for disbursement of final pension, final GPF, GIS and gratuity along with salary for two months and interest for the delayed payment. 3.
Learned counsel for the Petitioner submits that the Petitioner initially joined in service on 01.03.1986 in Dhenaeswar High School, Goudasahi, Jajpur as a Peon. The said School is a taken over Government School. The Petitioner retired from service on attaining the age of superannuation with effect from 31.08.2019. Although three years time have been elapsed in the meantime, the opposite parties have not paid the retiral and pensionary benefits payable to the petitioner, as a result of which the Petitioner is facing difficulties
// 2 // in managing his family as well as his basic needs. 4.
It is further submitted by the learned counsel for the Petitioner that the Petitioner has submitted a representation before the District Education Officer, Jajpur on 01.10.2021 which was sent to the District Education Officer by registered post. Till date no decision has been taken on the representation filed by the Petitioner. 5.
Mr.Jena, learned Standing Counsel for School & Mass Education department submits that he will have no objection if a direction is given to the District Education Officer, Jajpur, Opposite Party No.3 to take immediate and prompt action in the matter and to finalise the procedural requirement for disbursement of the Petitioner's retiral dues and pensionary benefits. 6.
Having heard learned counsel for the parties, the writ application is disposed of with a direction to the District Education Officer, Jajpur, Opposite Party No.3 to consider the representation of the Petitioner, which is pending before him and dispose of the same and further consequential action shall be taken processing the claim of the Petitioner in respect of the retiral dues as well as the pensionary benefits as admissible and payable to the Petitioner in law within a period of four weeks from the date of production of certified copy of this order. In the event, the Petitioner is found entailed, the benefits as claimed by him in the representation, the same shall be disbursed in favour of the Petitioner within a period of 12 weeks from the date of production of certified copy of this order. 7.
With the aforesaid observation the writ application is disposed of.
