This matter is taken up through hybrid mode.

Heard Mr. K.A. Guru, learned counsel for the petitioner and Mr. P.P. Mohanty, learned Addl. Government Advocate. 3.

The petitioner has filed this writ petition seeking direction to the opposite parties to declare the petitioner as the highest bidder with respect to Debhog sand quarry under the Tahasildar, Basta, and to issue Form-F in her favour within a stipulated time so as to carry out the mining activities.

Mr. K.A. Guru, learned counsel for the petitioner states that since appeal provision is there under the Rules, the petitioner may be permitted to approach the appellate authority, provided certified copy of the order settling the aforesaid sand quarry is granted by the Tahasildar.

Mr. P.P. Mohanty, learned Addl. Government Advocate states that if the petitioner makes proper application in accordance with law, there is no impediment on the part of the Tahasildar to provide the certified copy of the order settling the aforesaid sand

quarry.

In the above view of the matter, this writ petition stands disposed of granting liberty to the petitioner to pursue her remedy before the appropriate forum in accordance with law. 7.

Issue urgent certified copy as per rules.
