Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 28.01.2020 in connection with Padmapur P.S. Case No. 09 of 2020 corresponding to C.T. Case No. 22 of 2020 pending in the court of learned Additional Sessions Judge, Gunupur for the alleged commission of offence under Sections 498(A)/304(B)/302/34 of IPC read with Section 4 of D.P. Act.

The petitioner is the brother-in-law of the deceased, who had allegedly subjected her to physical and mental torture in connection with demand for dowry.

It is submitted by learned counsel for the petitioner that the allegations are on general terms and nothing specific has been attributed to the petitioner. That apart, the co-accused persons,
namely, Jodi Sahu and Namita Sahu, who are mother-in-law and sister-in-law respectively of the deceased and stand on the same footing, have already been released on bail as per orders passed by this Court in BLAPL Nos. 5604 and 5603 of 2021 respectively. 6.
Learned Additional Standing Counsel while opposing the prayer for bail, however does not dispute the above factual contentions.

Considering the submissions made, the materials on record, the period of detention already undergone and the fact that the coaccused persons who stand on similar footing have already been released on bail, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail. 8.
The BLAPL is accordingly disposed of.
5. Urgent certified copy of this order be granted on proper application.
