This matter is taken up through Video Conferencing mode. 2.

The present CMP application has been filed seeking a direction to the learned Civil Judge (Senior Division), Jagatsinghpur to dispose of CS.No.46 of 2012 pending before him.

It is submitted by the learned counsel for the Petitioner that the Petitioner is aged about 70 years and as such he cannot see the end of the litigation during his life time. It is further submitted by the learned counsel for the petitioner that the matter is lingering since 2012. He also submits that the hearing in the suit is concluded and posted for pronouncement of order.

In view of the facts stated hereinabove, this Court disposes of the CMP application with a direction to the learned Civil Judge (Senior Division), Jagatsinghpur to make all endeavour to dispose of C.S.No.46 of 2012 pending in his file, as expeditiously as possible preferably within a period of three months hence. 5.

With the aforesaid observation, the CMP is disposed of. 6.

As the restrictions due to resurgence of COVID -19 situation

// 2 // are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
