The Petitioner apprehending his arrest in Talasari Marine P.S. Case No.19 of 2018 corresponding to C.T. Case No.279 of 2018 pending in the court of Gramya Nayalaya, Bhogarai registered for alleged commission of offence punishable under Sections 302/34 IPC has filed this petition for his release on pre-arrest bail.

Heard learned counsel for the petitioner and learned counsel for the State.

It appears that the Petitioner earlier approached this Court in ABLAPL No.2309 of 2021 and this Court vide order dated 22.07.2021 directed that if the Petitioner surrenders before the court in seisin over the matter within four weeks, the court in seisin over the matter shall release him on bail. Without surrendering before the court in seisin over the matter pursuant to the said order, he filed I.A No.1380 of 2021 for
// 2 // extension of time to surrender before the court in seisin over the matter pursuant to the order dated 22.07.2021. This Court vide order dated 26.11.2021 was not inclined to extend the time of surrendering of the Petitioner and rejected the interlocutory application. Now, the Petitioner has come to this Court seeking pre-arrest bail.

Considering the aforesaid facts and the submissions made, this Court is not inclined to entertain this application for pre-arrest bail. Accordingly, the ABLAPL stands rejected. (S. Pujahari) Judge PKS
