Heard learned counsel for the Parties.

There is serious allegation involving removal of Fence and Shop on Government land creating hindrance involving the Petitioners. It is alleged that even though application was put up since August 2021 and in spite of same being forwarded to the Tahasildar, Basta by Deputy Collector, Revenue Collector, Balasore since 03.09.2021, there has been no action as of now. 3.

Keeping this in view and also taking into consideration that the Petitioners request has already reached the Tahasildar, this Court in disposal of the writ petition directs the Tahasildar, Basta Opposite Party No. 2 in the event of receipt of any such application, preliminary inquiry may be conducted. In the event there is material disclosing illegal encroachment, proceeding, as appropriate, under the provision of OPLE Act, involving the parties likely to be affected shall be initiated and shall be concluded further also involving the

// 2 // complainant as well as the party likely to be affected at least within a period of four months of the receipt of report of preliminary inquiry within two months.
