This is the second journey of the Petitioner, who is in custody in connection with Chhendipada P.S. Case No.308 of 2021 corresponding to C.T. (S) Case No.147 of 2021 on the file of learned Sessions Judge, Angul for alleged commission of offence under section 452/376/294/506 of the IPC, in filing this application under section 439 Cr.P.C., has prayed for his release on bail.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions made and further keeping in view the role said to have been played by this Petitioner as those emanate from the materials on record and as also the

// 2 // surrounding circumstances; while being not inclined to reconsider the prayer for grant of bail to the Petitioner at this stage; this application is disposed of granting liberty to the Petitioner to renew his prayer for grant of bail before the Trial Court after examination of the victim in the trial. The Trial Court is directed to take all such effective steps as provided in law for early examination of the victim so as to enable the Petitioner to exercise the liberty as aforegranted. 5.

The BLAPL is accordingly disposed of.
