This matter is taken up through hybrid mode.

This application has been filed by the Petitioner for willful violation of the Order dated 07.01.2021, passed in W.P.(C) No.21426 of 2020, vide which a direction was given to the Competent Authority to immediately restore the position of the Petitioner to the post he was holding on the date of suspension and by way of revocation of suspension Order, which will be subject to outcome in the event any disciplinary proceeding is initiated against the Petitioner.

This matter is taken up as a first case on being mentioned by the learned Counsel for the Petitioner, in absence of the learned Counsel for the Opposite Party-Contemnor.

Learned Counsel for the Petitioner fairly submits before this Court that though on the date of suspension he was Secretary InCharge of the Society, since in the meantime the post of Secretary has been filled up, now he has been reinstated in the post of Assistant Secretary of the said Society.

He further submits that the Petitioner has been reinstated in his former post but keeping a grudge, the Authority concerned are not paying his salary for the last three months, though he is working and orally prays for a direction to the Authority concerned to release the salary of the Petitioner.

Admittedly, the said prayer made by the learned Counsel for the Petitioner is beyond the scope for adjudication in the present proceeding. It is open for the Petitioner to approach the appropriate forum for redressal of his grievances, if he is so advised. 7.

Since the direction given by the coordinate Bench in W.P.(C) No. 21426 of 2020 has already been complied with in the meantime, the Contempt proceeding is here by dropped and CONTC stands disposed of.

Since the matter is taken up on being mentioned by Mr. A. Tripathy, learned Counsel for the Petitioner, he is requested to inform the learned Counsel for the Opposite Party-Contemnor regarding the outcome of to-day's proceeding. Banita (S.K. MISHRA) JUDGE
