IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.32878 of 2022 Sri Damodar Swain ....
Petitioner Mr. Manas Pati, Advocate -versusState of Odisha and others ....
Opposite Parties Mr. P.K. Rout, AGA
CORAM:
JUSTICE A.K. MOHAPATRA Order No.
ORDER
05.12.2022 01.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2.
Heard learned counsel for the Petitioner and learned counsel for the State.
3.
The Petitioner has filed this writ petition seeking direction to the Opposite Parties to modify the grade pay to Rs.5400/- instead of Rs.4800/- at the stage of 2nd financial upgradation with effect from 01.01.2013 in favour of the Petitioner as has been sanctioned in favour of similarly employee under Annexure-3 with all consequential benefits within a stipulate time. 4.
Mr. M. Pati, learned counsel for the Petitioner contended that similar matter had come up for consideration before this Court in W.P.(C) No.6087 of 2020 (Trilochan Sethy v. State of Odisha and others), wherein such benefit has been extended to the Petitioner in the said writ petition under Annexure-3. It is contended that since the Petitioner stands in the same footing, the benefit should have been extended in favour of the Petitioner.
// 2 // 5.
Considering the contention raised by learned counsel for the Petitioner and after going through the records, this writ petition stands disposed of directing Opposite Party No.2 to consider the representation of the Petitioner under Annexure-4 in the light of the order passed by this Court in W.P.(C) No.6087 of 2020 (Trilochan Sethy v. State of Odisha and others) and taking into consideration Annexure-3, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order.
6.
With the above direction, the Writ Petition stands disposed of. Urgent certified copy of this order be granted on proper application.
