This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for modification of the dated 12.01.2022 and for extension of time to surrender in the Court below.

Learned counsel for the petitioner submitted that petitioner no.1, namely, Angad Kei @ Angad Behera is also known as Kandarpa Behera and the same may be reflected in the order dated 12.01.2022. Learned counsel for the State was asked to obtain instruction though the Inspector in-charge of Krushna Prasad police station as to whether Angad Kei @ Angad Behera and Kandarpa Behera is the one and the same person or not.

Today, learned counsel for the State has

// 2 // produced the written instruction received from the Inspector in-charge of Krushnaprasad police station dated 27.11.2022 wherein it is mentioned that the real name of the petitioner is Kandarpa Behera. The written instruction is taken on record.

Considering the submission made by the learned counsel for the respective parties and in view of the report furnished by the Inspector in-charge of Krushnaprasad police station, the name of the petitioner no.1 shall also be read as Kandarpa Behera in the cause title and the date of surrender of the petitioner as fixed as per order dated 12.01.2022 is extended till 23.12.2022. The rest part of the order dated 12.01.2022 remains unaltered.

I.A. is accordingly disposed of.

Issue urgent certified copy as per Rules.
