Copy of the writ petition be served on Mr. A. Mohanty, learned counsel appearing for the opposite parties in course of the day. 3.

Heard Mr. S. Mishra, learned counsel for the petitioner and Mr. A. Mohanty, learned counsel appearing for the opposite parties. 4.

Mr. S. Mishra, learned counsel for the petitioner contended that though this Court has already disposed of the writ petition bearing W.P.(C) No. 7990 of 2005 on 20.01.2016, directing the petitioner to prefer appeal, but due to miscommunication, steps were not taken to prefer the same. Therefore, it is contended that the petitioner may be permitted to prefer appeal so that the same can be adjudicated by the appropriate forum in accordance with law, to which learned counsel appearing for the opposite parties has raised no objection. 5.

In the above view of the matter, this writ petition stands disposed of permitting the petitioner to prefer appeal before the appropriate forum within a period of one month in pursuance of the order dated 20.01.2016 passed in W.P.(C) No. 7990 of 2005.

Issue urgent certified copy as per rules.
