JUSTICE S.K. SAHOO Order No.

ORDER

14.12.2022 01.

This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner as well as learned Addl. Government Advocate for the State of Odisha.

The petitioner Basanti Amat has filed this writ petition challenging the selection of opposite party no.6 Manorama Sethi for the post of Anganwadi

// 2 // Helper in Kundanali-2 Anganwadi Centre by the opposite party no.4 C.D.P.O., Athamallik without holding any village level meeting of women.

Learned counsel for the petitioner submitted that the petitioner along with the villagers have filed a representation on 18.10.2022 before the SubCollector, Athamallik (opposite party no.3) under Annexure-10 series but no action has been taken thereon.

Learned counsel for the State submitted that since the petitioner is making a prayer for selection as Anganwadi Helper in place of opposite party no.6, she should separately file a representation before the opposite party no.3 highlighting her grievances. Considering the submissions made by the learned counsel for the respective parties and in view of the limited nature of prayer, without expressing any opinion on the merits of the case, it is ordered that if an application is filed by the petitioner ventilating her grievances before the Sub-Collector, Athamallik (opposite party no.3) within a period of two weeks from today along with a copy of this order, the same shall be considered by the SubCollector, Athamallik (opposite party no.2) in accordance with law within a period of four weeks from the date of filing of such application after giving opportunity of hearing to the respective sides.

// 3 // Accordingly, this writ petition is disposed of. Issue urgent certified copy as per Rules.
