This matter is taken up through Hybrid Mode.

Heard Mr. S. Mohanty, learned counsel for the petitioners, Mr. P. Mohapatra, learned Additional Standing Counsel for the State and Mr. G. N. Das, learned counsel appearing for the Opposite Party No.2.

The aforesaid CRLMC has been filed for quashing of the proceeding in G.R. Case No.1341 of 2021 on the file of Learned S.D.J.M., Jagatsinghpur arising out of Jagatsinghpur P.S. Case No. 618 of 2021. During pendency of the CRLMC with the intervention of the well-wishers from both the sides, the matter is stated to have been compromised and settled out of Court.

It is stated by the learned counsel for the petitioner that while filing the affidavit at Annexure-2, inadvertently the P.S. Case Number and G.R. Case Number has been wrongly reflected. In as much as instead of correct number of P.S. Case Number is 618 of 2021 and G.R. Case Number is 1341 both in Paragraph Nos. 1 and 4 numbers has been wrongly mentioned as 619 and 1342 respectively.

On the prayer of the learned counsel for the petitioner is permitted to correct the same in Court today. 6.

Taking note of the submissions made across the Bar, the criminal proceeding in G.R. Case No.1341 of 2021 on the file of Learned S.D.J.M., Jagatsinghpur arising out of Jagatsinghpur P.S. Case No. 618 of 2021 is quashed, taking into account, the affidavit at Annexure-2, in the tune of the law laid down by the Apex Court in the Case of Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karkur and others v. State of Gujarat and another, reported in AIR 2017 SCC 4843.

The CRLMC thus stands disposed of.
