Heard learned counsel for the Parties.

This Court records the submission of Mr.Swain, learned counsel for the Petitioners that grandfather of the Petitioners as stated in genealogy para-5 of the Writ Petition along with one co-sharer (Natabara Ojha) name was recorded in the Record of Right issued by the Tahasildar, Dharmasala vide Annexure-1, the co-sharer sold the property vide Annexure-2 to the Petitioners 1 & 2 who are the grandson and daughter. Fact reveals as Annexure-1, the Record of Right where the name of the grandfather has been recorded who is the owner of the property as indicated, there is no dispute to accept the rent from the present Petitioners as per the Record of Right of sale deed. But the Tahasildar, Dharamasala declined to accept rent from the Petitioners even they are family member as stated in the Writ Petition.

In the circumstance this Court directs the Tahasildar, Dharamasala- Opposite Party No.3 to accept the land revenue on

// 2 // offering the arrear, if any, by the Petitioners in respect of Khata No.202, Mouza- Telipokhari under Annexure-1. Let the offer be made within a period of seven days along with supply of copy of order of this Court.

With the above observation, the Writ Petition stands disposed of.
