This matter is taken up through video conferencing mode. 2.

This application has been filed for condonation of delay of 140 days in preferring the application.

Having heard learned counsel for the parties and on perusal of the affidavit filed along with the application, this Court is satisfied with the sufficiency of cause of 140 days delay in filing the CMAPL application.

The delay is condoned and the I.A. is accordingly allowed. (Dr. B.R. Sarangi) Judge CMAPL No. 367 of 2021 This application has been filed for recalling of the order dated Order No.

27.07.2021 passed in WPC (OAC) No.2311 of 2015. 2.

Mr. S.K. Swain, learned counsel for the petitioner states that

though he has already entered appearance on 05.07.2021 by filing vakalatnama taking consent from the previous counsel, but his name has not been indicated in the cause list as mentioned in sl.no. 122 dated 27.07.2021. Thereby, he could not able to take steps in the matter. 3.

Considering grounds taken in the application itself and after hearing learned counsel for the parties, the order dated 27.07.2021 is hereby recalled and WPC (OAC) No.2311 of 2015 is restored to its original file.

Accordingly, the CMAPL is allowed.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021.
