Heard learned counsel for the Petitioner, learned Addl. Government Advocate for the State. Perused the records. 3.
This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offence punishable under Sections 498-A, 506, 294, 323, 507/34 of the Indian Penal Code read with Section 4 of D.P.Act.

It is submitted by the learned counsel for the Petitioner that the present Petitioner is served in Indian Army at the moment He also submits that the present case arises out of a misunderstanding between the husband and wife. Accordingly, the present F.I.R. has been registered at the instance of the informant-wife.

Considering the nature of allegations made, gravity of the offence and the facts of the case, it is directed that in the event of arrest of the Petitioner by the Arresting Officer in connection with Balikuda P.S.Case No.516 of 2022, he shall be released on bail subject to the condition that he shall pay monthly maintenance to the informant-wife at the rate of Rs3000/- (Rupees Three thousand) per month.

The ABLAPL is disposed of accordingly.
