Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 09.11.2021 in connection with Sohela P.S. Case No. 210 of 2021 corresponding to Spl. G.R. Case No. 94 of 2021 (Comp. Regd. No. 94 of 2021) pending in the court of learned Additional Sessions Judge, Padampur for the alleged commission of offence under Sections 21(b)/25/29 of the NDPS Act read with Section 25 of Arms act.

Considering the submissions made, the materials on record, the period of detention already undergone and the fact that the seized contraband is less than commercial quantity weighing 340 grams of codeine phosphate, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally

appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
