ORDER (Oral) 05.01.2022 02.

1. This matter is taken up by hybrid mode.

2. The guarantor is before this Court with a plea to save his residential house, (secured asset), which was being put to auction on 16th December, 2021 for an outstanding liability of 1 crore approximately.

3. In view of the readiness and willingness shown by the Petitioner to deposit a substantial upfront amount to show the bona fide intention and to clear the remaining balance within a month, this Court had issued notice vide order dated 15.12.2021 and the Petitioner was directed to deposit a sum of 50 lakhs and upon doing so, the successful bid, if any, was not to be confirmed without leave of the Court.

4. At the time of hearing, counsel for the Petitioner states that the Petitioner has not deposited the required amount in terms of the interim order dated 15.12.2021.

5. At this stage, counsel for the Petitioner seeks permission to withdraw the present writ petition and file a Memo to that effect, which be kept on record.

6. Accordingly, the writ petition is dismissed as withdrawn.
