1. Heard the learned counsels for the Petitioner and the State.

2. By means of this application, the Petitioner seeks grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 498-A/494/506, I.P.C. in connection with Soro P.S. Case No.389 of 2021 corresponding to C.T. Case No.818 of 2021 pending in the court of learned J.M.F.C., Soro.

3. Having regard to the nature of allegation and facts of the case, since the marriage took place about 26 years back, it is expedient that the Investigating Agency should resort to the provision of Section 41-A, Cr.P.C.

4. With the aforesaid observation, the Petitioner is permitted to withdraw this ABLAPL, which is disposed of accordingly. ( Chittaranjan Dash ) Judge S.K. Parida
