This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Telkoi P.S. Case No.77 of 2021 corresponding to G.R. Case No.21 of 2021 pending in the Court of learned J.M.F.C., Telkoi for alleged commission of offences under sections 379, 411 of the Indian Penal Code and section 11(1) of the Prevention of Cruelty to Animals Act, 1960.
Perused the F.I.R. annexed to the anticipatory bail application.
// 2 // Learned counsel for the State on instruction submitted that the petitioner is having no criminal antecedents in Telkoi police station and in pursuance of the order dated 19.01.2022, he appeared before the Investigating Officer, but he is unable to say the name of his associates.
Considering the nature of dispute between the parties, the offences are triable by Magistrate, taking into account the nature of accusation and the fact that the petitioner has been granted interim protection since 19.01.2022 and there is no material that he has misutilized his liberty, the interim order dated 19.01.2022 is made absolute.
The ABLAPL is accordingly disposed of.
